Welcome to Arc. The terms “we”, “us” and “our” refer to Arc.
Arc operates this website and online store, including all related information, content, features, tools, products and services (the “Services”). Our store is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service (“Terms”), together with any policies referenced herein, describe your rights and responsibilities when you use our Services or purchase from us.
By visiting, interacting with or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you should not use our Services.
1. ACCESS AND ACCOUNT
By using our Services, you confirm that you are legally able to enter into a binding agreement in your jurisdiction.
When using our Services or making a purchase, you may be asked to provide information including your email address, billing information, payment information and shipping address. You agree that the information you provide is accurate, current and complete.
You are responsible for maintaining the confidentiality of any account credentials and for activity conducted through your account.
2. OUR PRODUCTS
We make every effort to describe and display our jewellery as accurately as possible. However, colours and appearance may vary slightly depending on your screen, device, lighting and other factors.
Product measurements are approximate unless otherwise stated.
Our jewellery may contain natural gemstones. Natural variations in colour, tone, clarity, markings and appearance are expected and make each stone unique. These natural characteristics are not considered defects.
Because of these variations, the gemstone you receive may not look exactly identical to the stone shown in photographs on our website.
We reserve the right to change or discontinue products and to limit quantities or availability, subject to applicable law.
3. MATERIALS AND JEWELLERY CARE
Materials and specifications are stated on the relevant product page.
Jewellery is delicate and should be handled with appropriate care. Exposure to water, perfumes, lotions, chemicals, sweat and other substances may affect the appearance and longevity of jewellery, particularly plated pieces.
Normal wear, including gradual changes to plating or surface finish over time, may occur depending on wear and care and does not necessarily indicate a manufacturing defect.

4. ORDERS
When you place an order, you are making an offer to purchase the selected products.
After placing an order, you will receive an order confirmation by email. We reserve the right to decline or cancel an order where reasonably necessary, including in cases of payment issues, suspected fraud, stock errors, incorrect pricing or other errors affecting the order.
If we cancel an order after payment has been received, the amount paid for the cancelled item or order will be refunded.
Please review your order carefully before submitting it. Once an order has entered processing or production, we may not be able to accommodate changes or cancellations.
Your statutory consumer rights are not affected by this section.
5. PERSONALISATION AND ENGRAVING
Please carefully check all names, initials, dates, spelling and other personalisation details before submitting your order.
Personalised and engraved pieces are made according to the information provided by you. Arc is not responsible for errors in personalisation where the item has been produced according to the information submitted with the order.
Once personalisation or engraving has begun, changes or cancellations may not be possible.
Personalised items may be subject to different return or exchange conditions from non-personalised items, as explained in our Refund Policy.
Nothing in this section limits any rights you may have in relation to defective, damaged or incorrectly supplied products under applicable law.
6. PRICES AND PAYMENT
Prices are displayed in the currency shown on the website.
Applicable taxes, shipping charges and other charges, where relevant, will be displayed during checkout.
For international orders, customs duties, import taxes or other charges may apply depending on the destination. Where these charges are not collected by us at checkout, they may be payable by the recipient.
We reserve the right to change prices at any time. Price changes will not normally affect orders that have already been confirmed, except where permitted or required by applicable law.
Payment must be made using one of the payment methods available at checkout. You confirm that you are authorised to use the payment method provided.
7. PRODUCT AVAILABILITY
All products are subject to availability.
We aim to keep our inventory information accurate, but occasionally a product may become unavailable after an order has been placed.
If we are unable to fulfil all or part of your order, we will contact you and provide an appropriate solution, which may include cancellation and a refund for the unavailable item.
8. SHIPPING AND DELIVERY
Shipping destinations, estimated delivery times and applicable charges are described in our Shipping & Delivery Policy and/or displayed during checkout.
Delivery times are estimates unless expressly stated otherwise. Delays may occasionally occur due to circumstances outside our reasonable control, including courier delays, customs processing or other logistical events.
Please ensure that your delivery information is complete and accurate when placing your order.

9. RETURNS, EXCHANGES AND REFUNDS
Returns, exchanges and refunds are governed by our Refund Policy, which forms part of these Terms.
Please review the Refund Policy before making a purchase, particularly when ordering personalised or engraved jewellery.
Nothing in these Terms or our Refund Policy excludes or limits any mandatory rights or remedies available to you under applicable consumer-protection law.
10. PROMOTIONS AND DISCOUNT CODES
From time to time, we may offer promotional codes, discounts or other offers.
Promotions may be subject to additional terms communicated at the time of the offer.
Unless otherwise stated, promotional codes cannot be combined, cannot be exchanged for cash and cannot be applied retrospectively to completed orders.
We reserve the right to amend or withdraw promotions where reasonably necessary, subject to applicable law.
11. INTELLECTUAL PROPERTY
The Services, including the Arc name, branding, logos, jewellery designs, photographs, graphics, text, videos and other content, are owned by or licensed to Arc and are protected by applicable intellectual-property laws.
You may use the Services for personal, non-commercial purposes only.
You may not reproduce, distribute, modify, publish, sell, commercially exploit or otherwise use our content without our prior written permission, except where permitted by applicable law.
Shopify's names, logos, product and service names and other intellectual property belong to Shopify or its licensors.
12. OPTIONAL TOOLS AND THIRD-PARTY SERVICES
We may provide access to tools, features or services operated by third parties, including payment providers, delivery providers, personalisation services and other technology providers.
Your use of third-party services may also be subject to the relevant third party's terms and privacy policies.
To the extent permitted by applicable law, we are not responsible for third-party websites or services that are outside our control.
13. RELATIONSHIP WITH SHOPIFY
Arc is powered by Shopify, which enables us to provide the Services to you.
However, any sales and purchases you make through our store are made directly with Arc. Shopify is not the seller of the products purchased through our store and is not responsible for fulfilling your order.
Your use of Shopify-related functionality may also be subject to applicable Shopify terms and privacy practices.
14. PRIVACY
Personal information collected through our Services is handled in accordance with our Privacy Policy.
Because our store is hosted by Shopify, certain personal information may also be collected and processed by Shopify and other service providers in order to operate and provide the Services.

15. FEEDBACK AND REVIEWS
If you submit reviews, photographs, comments, suggestions or other content to us (“Feedback”), you confirm that you have the right to provide that content.
You grant us permission to use, reproduce and display Feedback in connection with operating and promoting Arc and our Services, subject to applicable law.
Feedback must not infringe the rights of another person, contain unlawful or misleading material, or contain malicious software or code.
16. ERRORS, INACCURACIES AND OMISSIONS
Occasionally, information on our website may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges, delivery times or availability.
We reserve the right to correct errors or inaccuracies and update information where reasonably necessary.
If an error affects an order you have already placed, we will handle the matter in accordance with applicable law and, where appropriate, contact you regarding the available options.
17. PROHIBITED USES
You may use our Services only for lawful purposes.
You must not use our website or Services to violate applicable laws; infringe our intellectual-property rights or those of others; transmit malicious software; collect personal information about others unlawfully; engage in fraud or misleading activity; interfere with the security or operation of our website; or otherwise misuse the Services.
We reserve the right to restrict or terminate access to the Services where we reasonably believe these Terms have been violated.
18. DISCLAIMER OF WARRANTIES
We aim to provide accurate and reliable Services, but we cannot guarantee that our website will always operate without interruption, delay or error.

Nothing in these Terms excludes any warranty, guarantee, condition or consumer right that cannot legally be excluded.

To the extent permitted by applicable law, Arc will not be liable for indirect, incidental, special or consequential losses arising from your use of the Services or products purchased through the Services.

20. INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold harmless Arc, Shopify and our respective affiliates, employees, contractors and service providers from third-party claims arising from your unlawful use of the Services, your material breach of these Terms or your infringement of the rights of another person.
21. SEVERABILITY
If any provision of these Terms is determined to be unlawful, void or unenforceable, that provision will be enforced to the maximum extent permitted by law or, where necessary, severed from these Terms.
The remaining provisions will continue in effect.
22. WAIVER AND ENTIRE AGREEMENT
Our failure to exercise or enforce a right under these Terms does not constitute a waiver of that right.
These Terms, together with the policies and other terms referenced herein, constitute the agreement between you and Arc regarding your use of the Services and purchases made through our store, subject to applicable law.
23. ASSIGNMENT
You may not transfer or assign your rights or obligations under these Terms without our prior written consent.
We may transfer or assign our rights and obligations where permitted by applicable law.
24. GOVERNING LAW
These Terms and purchases made through our Services are governed by the applicable laws of the United Arab Emirates.
Nothing in these Terms affects any mandatory rights or remedies available to consumers under applicable law.

We may update these Terms from time to time to reflect changes to our Services, business practices or applicable requirements.
